Limited Warranty for Med Dimensions, LLC

1. Warranty Coverage

Med Dimensions, LLC (the “Company”) warrants to the original purchaser that its models (the “Physical Products”) are free from defects in design, operation, workmanship, and materials under normal use and service for a period as specified below from the date of purchase (the “Warranty Period”).

  • Non-consumable Physical Products: Six (6) months from the date of delivery.
  • Consumable Physical Products (without contained fluid): Three (3) months from the date of delivery or until first use, whichever comes first.
  • Consumable Physical Products (with contained fluid): One (1) month from the date of delivery or until first use, whichever comes first.

Definitions:

  • Non-consumable Physical Products: Parts or components of the Physical Product that are not expected to be replaced frequently, often, or ever under normal use. These parts are integral to the Physical Product’s overall function and are not considered expendable.
  • Consumable Physical Products: Parts or components of the Physical Product that are designed to be replaced regularly due to wear and tear or depletion. These parts are considered expendable and are not covered by the same warranty terms as non-consumable physical products.
  • First Use: The initial utilization of the Physical Product or a specific part thereof for its intended purpose.

2. Warranty Limitations

This warranty extends only to the original purchaser of the Physical Product and is not transferable. The Company’s liability under this warranty is limited to repair or replacement of the defective Physical Product or part thereof.

Defects in Design A defect in design occurs when the Physical Product does not function as intended due to an error in the conceptualization or planning of the physical product. This includes, but is not limited to, flaws in the overall structure, components, or systems of the Physical Product that prevent it from performing its intended purpose.

Defects in Operation A defect in operation arises when the Physical Product fails to function as intended due to an error in its design, manufacturing, or assembly. This includes, but is not limited to, malfunctions, inconsistencies, or irregularities in the Physical Product’s performance that impede its intended use.

Defects in Workmanship A defect in workmanship occurs when the Physical Product is not manufactured or assembled according to the Company’s specified standards. This includes, but is not limited to, errors in the manufacturing process, such as improper material handling, assembly errors, or deviations from design specifications.

Defects in Materials A defect in materials arises when the materials used to manufacture the Physical Product do not meet the Company’s quality standards. This includes, but is not limited to, flaws in the raw materials, such as impurities, defects, or inconsistencies, that affect the Physical Product’s performance or durability.

3. Exclusions

This warranty does not cover:

  • Damage caused by accident, misuse, abuse, neglect, alteration, or improper installation.
  • Damage caused by use of the Physical Product for purposes other than its intended use.
  • Damage caused by failure to follow the Company’s operating instructions.
  • Damage caused by acts of God, such as fire, flood, or earthquake.
  • Normal wear and tear.
  • Certain consumable items, such as batteries.
  • Physical Products that have been repaired or modified by anyone other than the Company or its authorized representatives.
  • Any incidental or consequential damages, including, but not limited to, loss of profits, loss of use, or damage to property.

The Company offers suggestions for the number of uses a model might withstand but these number of uses are not a guarantee nor will they be warrantied if the model fails in less than those number of uses.

Obtaining Warranty Service

To initiate a warranty claim, please contact Med Dimensions, LLC at:

A copy of your proof of purchase will be required to process your warranty claim. The Company will make its best effort to respond to warranty claims within 3 business days but cannot guarantee this timeframe.

5. Return and Replacement

If the Company determines that the Physical Product is covered by this warranty, it will repair or replace the defective Physical Product or part thereof at no charge to the purchaser within the United States. United States clients will not be asked to cover shipping costs. International customers will be asked to cover shipping costs, export/import fees, and any duties or taxes for the replacement product.

6. Disclaimer of Implied Warranties

Except as expressly provided herein, the Company disclaims all other warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

7. Limitation of Liability

In no event shall the Company be liable for any incidental or consequential damages, including, but not limited to, loss of profits, loss of use, or damage to property, arising out of or in connection with the sale or use of the Physical Product.

8. Modification of Warranty

Med Dimensions, LLC reserves the right to modify or amend this warranty at any time. Any changes to this warranty will be effective upon posting on our website or through other notification methods.

9. Governing Law

This warranty shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

This warranty provides you with specific legal rights, and you may also have other rights, which vary from state to state.
